Driving Under the Influence (DUI) is one of the most dangerous actions a driver can take, leading to thousands of preventable injuries and deaths each year. Nevada’s laws against impaired driving are extremely strict, with severe and long-lasting consequences. Understanding these laws is critical not only for passing the knowledge test but for making responsible choices that protect your life, your driving privilege, and the safety of your entire community.

In Nevada, a person is guilty of Driving Under the Influence (DUI) if they operate a motor vehicle while impaired by alcohol, any controlled substance, or a combination of substances that renders them incapable of driving safely. This includes illegal drugs as well as prescription and over-the-counter medications that affect motor skills or judgment.

Blood Alcohol Concentration (BAC) Limits

Nevada has “Per Se” laws, which means it is automatically illegal to drive with a BAC at or above a specific level, regardless of whether you appear to be impaired.

  • 21 or Older: It is illegal to drive with a BAC of 0.08% or more.
  • Under 21: It is illegal to drive with a BAC of 0.02% or more. This is a “zero tolerance” approach.
  • Commercial Drivers: It is illegal to operate a commercial vehicle with a BAC of 0.04% or more.

For marijuana, it is illegal to drive with 2 nanograms per milliliter of marijuana in the blood, or 5 nanograms per milliliter of marijuana metabolite. A driver can be arrested and convicted for DUI with a BAC lower than 0.08% if there is evidence that they were too impaired to drive safely.
