Chapter 2: Speed Limits

Properly managing speed is one of the most critical skills for any driver, directly impacting safety and the ability to avoid crashes. Understanding Vermont’s speed laws is not just about knowing the numbers on a sign; it’s about adapting to changing conditions, a concept central to both the driver’s exam and real-world safety. Mastering these rules helps drivers maintain control of their vehicle, provides adequate time to react to hazards, and protects everyone on the road.

The Basic Speed Law

Vermont’s most fundamental rule regarding speed is the “Basic Speed Law.” This law requires a person to drive at a speed that is reasonable and prudent under all existing conditions, regardless of the posted maximum speed limit. The posted limit is the absolute maximum speed permitted in ideal conditions, not a target speed to be maintained at all times.

This means a driver must consider factors such as:

• Weather: Rain, fog, snow, or ice dramatically increase stopping distance and reduce visibility.
• Road Conditions: A driver must slow down for gravel roads, sharp curves, steep hills, or narrow lanes.
• Visibility: Darkness, sun glare, or heavy precipitation require slower speeds to ensure a driver can see and react to hazards.
• Traffic: In heavy traffic, a driver must reduce speed to maintain a safe following distance and be prepared for sudden stops.
• Hazards: The presence of pedestrians, bicyclists, or animals near the road requires increased caution and slower speeds.

Under the Basic Speed Law, a law enforcement officer can issue a ticket for driving the posted speed limit if conditions make that speed unsafe. For example, driving 50 mph on a highway during a blizzard is dangerous and illegal, even if 50 mph is the posted limit. In some situations, even 10 mph can be an unsafe speed.
