The Definition of Driving While Intoxicated in Missouri

In Missouri, DWI means driving while impaired by alcohol, illegal drugs, or prescription/over-the-counter medication. The law does not distinguish between substances; if your ability to drive safely is impaired, you can be charged. For drivers 21 and over, it is illegal to drive with a Blood Alcohol Concentration (BAC) of .08% or higher.

Drivers under 21 are subject to a “zero tolerance” law, making it illegal to drive with a BAC of .02% or higher. For commercial vehicle operators, the limit is .04%.
