Virginia DUI Laws
In Virginia, it is illegal to drive with a Blood Alcohol Concentration (BAC) of 0.08% or higher (0.02% for drivers under 21). A driver can also be convicted based on evidence of impairment, regardless of BAC level. This is known as Driving Under the Influence (DUI).
Penalties for a first-time DUI conviction include a mandatory minimum fine of $250, license revocation for one year, and possible jail time. Refusing to take a breath test results in an immediate license suspension and can be used as evidence in court.
