These Terms limit the liability of the Company (Section 6). Your use of the Site constitutes acceptance of these limitations.

1. Introduction and Acceptance of Terms

Welcome to testsdmv.com (the “Site”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “You,” or “Your”) and the Administration of the Site (“Company,” “We,” “Us,” or “Our”).

By accessing the Site, creating an account, browsing practice materials, or purchasing a Premium Pass, You acknowledge that You have read, understood, and agree to be bound by these Terms in their entirety. These Terms are effective as of the date set forth above.

If You do not agree with any provision of these Terms, You must immediately discontinue all use of the Site. Continued use of the Site following any amendments to these Terms constitutes acceptance of such amendments.

By using the Site, You further acknowledge that:

  • The Site is provided for educational and informational purposes only
  • Certain provisions of these Terms limit the liability of the Company
  • Disputes may be resolved through binding individual arbitration
  • You waive the right to participate in class actions to the maximum extent permitted by law
  • All sales of Premium Passes are final due to immediate access to digital content

3. Nature of Services

3.1 Educational Purpose

The Site provides practice tests, exam simulators, study materials (“Study Guides”), educational content, and progress tracking tools intended exclusively to assist Users in preparing for Department of Motor Vehicles (DMV) and Commercial Driver’s License (CDL) theoretical knowledge exams.

All content is designed as a supplementary study aid to help Users familiarize themselves with the structure and subject matter of official exams. The Site does not guarantee that its content mirrors current official examinations in format, wording, difficulty, or scoring methodology.

3.2 Not a Government Agency

The Site is a private educational platform and is not affiliated with, associated with, authorized by, endorsed by, or officially connected to the Department of Motor Vehicles (DMV), the Federal Motor Carrier Safety Administration (FMCSA), any state licensing authority, or any other government agency in the United States or any other country.

WE ARE NOT AN OFFICIAL SOURCE OF DMV OR CDL INFORMATION. Users must always verify information with their local DMV office and refer to the official state Driver’s Manual as the primary authoritative source.

3.3 Supplementary and Interpretive Nature of Content

All materials on the Site, including test questions, answer explanations, and Study Guides, represent an independent interpretation, simplification, and restructuring of publicly available official state Driver’s Manuals. As such:

  • Content does not replace or supersede official driver’s manuals
  • Legal and technical language may be simplified for accessibility
  • Certain edge cases, exceptions, or recent legislative changes may not be reflected
  • Answer explanations represent the Company’s interpretive summary, not official government guidance

You should always refer to the official Driver’s Manual of your specific state as the primary source of truth before taking any official examination.

3.4 Test Count, Structure, and Content Overlap

The total number of tests displayed for a specific state may include standardized road sign tests that are shared across multiple states. This reflects the fact that traffic control devices and road signs are largely standardized at the federal level under the Manual on Uniform Traffic Control Devices (MUTCD).

As a result:

  • Some tests in one state’s section may be identical or substantially similar to tests in another state’s section
  • Road sign tests are included in the total displayed test count for usability and completeness
  • The Company makes no representation that all displayed tests represent unique, state-specific content

Users purchasing a Premium Pass for a specific state should understand that some content may overlap with other states they have previously accessed.

3.5 Changes in Laws, Exams, and Requirements

Traffic laws, examination formats, scoring standards, language availability, and licensing requirements are subject to change at any time without notice by government authorities. While the Company makes reasonable efforts to keep content current, We cannot guarantee that all materials reflect the most recent legislative or procedural updates. You are solely responsible for verifying current requirements with the appropriate authority before taking any official examination.

3.6 No Professional, Legal, or Certified Training Advice

The content on the Site is for general informational and educational purposes only. Nothing on the Site constitutes legal advice, official government guidance, certified driver training, or professional instruction of any kind. Reliance on the Site as your sole source of preparation is at Your own discretion and risk.


4. Accounts and Access

4.1 Account Registration

To access features such as progress tracking and test history, you must register an account using a valid email address and password. You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain the accuracy of your information and update it as necessary
  • Maintain the confidentiality of your login credentials and not disclose them to any third party
  • Notify us immediately if you become aware of any unauthorized use of your account at info@testsdmv.com

You are solely responsible for all activity that occurs under your account, whether or not you authorized such activity.

4.2 Account Types

4.3 Personal Use Only

Your account is for your individual, personal, non-commercial use only. You may not:

  • Share your login credentials with any third party outside your immediate household
  • Allow any other person to access or use the Site under your account
  • Resell, transfer, or sublicense access to the Site or its content
  • Use your account for commercial purposes, including tutoring or test preparation services offered to others, without prior written permission from the Company

We reserve the right to monitor usage patterns and suspend accounts that exhibit activity indicative of credential sharing, such as simultaneous logins from different geographic locations, abnormal session frequency, or usage patterns inconsistent with individual use.

4.4 Prohibition on Automated Access

You are strictly prohibited from using any automated systems, software, or tools to access the Site, including but not limited to:

  • Web scrapers, crawlers, or spiders of any kind
  • Automated testing tools or bots
  • Scripts designed to mass-download or extract content
  • Tools designed to reverse-engineer, mirror, or replicate Site content
  • AI training data collection tools or pipelines of any kind

Any detected automated access will result in immediate account termination without refund and may result in legal action under applicable intellectual property and computer access laws.

4.5 Suspension and Termination

The Company reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or permanently terminate any account in the event of:

  • Violation of any provision of these Terms
  • Fraudulent activity, including payment fraud or misrepresentation
  • Chargeback abuse or unauthorized payment disputes (see Section 5.7)
  • Automated access, scraping, or unauthorized data extraction
  • Any conduct the Company reasonably believes creates legal, financial, or reputational risk
  • Non-payment of amounts due

4.6 Effect of Termination

Upon termination of your account, whether by you or by the Company:

  • Your access to the Site and all content is revoked immediately
  • Access to any Premium Pass content is forfeited, regardless of remaining access time
  • No refunds will be issued for unused access time, except as required by applicable law
  • Data associated with your account may be retained in accordance with our Privacy Policy and applicable legal requirements
  • The following provisions of these Terms survive termination: Sections 6 (Disclaimers and Limitation of Liability), 7 (Intellectual Property Rights), 13 (Governing Law), 14 (Arbitration), 15 (Indemnification), and 17 (Limitation Period)

5. Plans, Pricing, Payments, and Refund Policy

5.1 One-Time Purchases

All Premium Passes are sold as one-time, non-recurring purchases. We do not offer auto-renewing subscriptions. Your payment method will not be charged again automatically. Access expires at the end of the purchased term as measured from the date and time of payment confirmation.

Eastern Time observes Daylight Saving Time (EDT, UTC−4) from March to November and Standard Time (EST, UTC−5) from November to March.

Prices are displayed in USD and are subject to change at any time. The price at the time of purchase is binding. We may offer promotional pricing at our discretion; such offers are subject to their own terms and may not be retroactively applied to prior purchases.

5.3 Payment Processing

All payments are processed exclusively through PayPal, our third-party payment processor. We do not store, collect, or have access to your credit card numbers, bank account details, CVV codes, or other financial credentials. By completing a purchase, you agree to PayPal’s terms of service and privacy policy.

We receive from PayPal only: payment confirmation status, transaction ID, and transaction amount. Premium Pass access is activated automatically upon confirmation of successful payment.

5.4 Taxes and Duties

The prices listed exclude any applicable sales tax, value-added tax (VAT), goods and services tax (GST), or other transaction taxes. You are solely responsible for determining and remitting any taxes applicable to your purchase under the laws of your jurisdiction.

5.5 No Refund Policy

ALL SALES ARE FINAL. Because We provide immediate, unrestricted access to digital content upon purchase confirmation, We adhere to a strict No Refund Policy. We do not offer refunds, credits, or exchanges under any of the following circumstances (this list is illustrative, not exhaustive):

  • Failure to pass any official DMV or CDL examination
  • Dissatisfaction with the format, style, or content of practice tests
  • Perceived inaccuracies or discrepancies between Site content and official exam content
  • Lack of use or forgetting to use the purchased access during the valid period
  • Purchasing the wrong plan, state, or language version
  • Technical issues caused by your device, browser, or internet connection
  • Changes in your personal circumstances (e.g., moved to a different state)
  • Discovering that the official exam in your state is not available in your preferred language
  • Discovering content overlap between state sections (see Section 3.4)

We strongly recommend reviewing the free content available on the Site before purchasing a Premium Pass to ensure it meets your needs.

5.6 Limited Exceptions

Refunds may be granted solely at the Company’s discretion and only in cases of verified technical failure on our part that prevents access to the purchased content, provided that:

  • You have contacted our support team at info@testsdmv.com and described the technical issue in sufficient detail
  • The Company has had a reasonable opportunity to investigate and attempt to resolve the issue
  • The Company has been unable to restore access within a reasonable timeframe

Disagreement with content quality, test difficulty, or exam correlation does not constitute a technical failure qualifying for a refund.

5.7 Chargeback Policy

You agree to contact the Company via email at info@testsdmv.com to attempt to resolve any billing disputes before initiating a dispute or chargeback with your bank or payment provider. Initiating a chargeback without prior communication constitutes a material breach of these Terms.

In the event of an unjustified chargeback or payment dispute initiated without prior contact:

  • Your account (both free and paid) will be immediately and permanently terminated
  • You will be denied future access to the Site
  • The Company reserves the right to report the incident to relevant fraud prevention databases
  • The Company reserves the right to recover any processing fees, administrative costs, and reasonable legal expenses incurred in responding to the dispute, to the extent permitted by applicable law

6. Disclaimers and Limitation of Liability

6.1 No Guarantee of Exam Results

The Site provides tools for self-directed study preparation. The Company makes no warranty, representation, or guarantee that Your use of the Site will result in passing any official DMV or CDL examination. Examination results depend entirely on Your individual knowledge, preparation effort, and performance on the day of the exam.

6.2 Content Accuracy Disclaimer

While We make reasonable efforts to ensure the accuracy, completeness, and currency of our content, the Site’s practice questions and explanations may contain errors, omissions, oversimplifications, or outdated information. We do not warrant that:

  • The content is error-free or fully accurate at any given time
  • The content reflects the most current version of applicable traffic laws
  • The questions are similar in wording, format, or difficulty to actual exam questions
  • The content covers all topics that may appear on any official examination

6.3 Language and Translation Disclaimer

Practice tests and Study Guides are available in multiple languages. Translations are produced using a combination of professional human translation and machine translation technologies. Machine translation is not infallible and may contain errors in technical terminology, legal language, or nuanced phrasing.

In the event of any discrepancy between a translated version of any material and the original English version, the English version shall prevail. The provision of materials in non-English languages does not guarantee that any official DMV or CDL examination is available in those languages in your state.

Special Notice for CDL Applicants: The Commercial Driver’s License examination in the United States is conducted primarily in English. CDL materials in other languages are provided solely to facilitate conceptual understanding. You must be able to understand and respond to all official exam content in English.

6.4 Service Availability Disclaimer

The Site is provided on an “AS IS” and “AS AVAILABLE” basis without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components.

6.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of income, employment opportunity, or business opportunity
  • Suspension, denial, or revocation of a driver’s license
  • Loss of data or progress statistics
  • Reputational harm, embarrassment, or emotional distress
  • Fines, penalties, or other costs imposed by government authorities
  • Damages arising from reliance on inaccurate or outdated content

THE FOREGOING EXCLUSIONS APPLY REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND REGARDLESS OF WHETHER THE COMPANY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF THE COMPANY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IF YOU HAVE NOT MADE ANY PAYMENTS, THE COMPANY’S LIABILITY IS LIMITED TO USD $10.00.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, the Company’s liability is limited to the maximum extent permitted by law.


7. Intellectual Property Rights

7.1 Ownership

All content on the Site — including but not limited to test questions, unique answer explanations, text, graphics, logos, page structure, Study Guides (“Cheat Sheets”), UI design, and the selection, arrangement, and coordination of materials — is the exclusive intellectual property of the Company and is protected by international copyright law, trademark law, and other applicable intellectual property legislation.

The Company’s content is original creative work. While it draws from publicly available official driver’s manuals, the unique manner in which content is selected, interpreted, phrased, structured, and explained constitutes original authorship protected under copyright law.

7.2 Limited License to Users

Subject to your compliance with these Terms, the Company grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site and its content solely for your personal, non-commercial educational purposes. This license does not include any right to:

  • Download, reproduce, or distribute any content beyond what is permitted by your browser’s standard caching
  • Copy, adapt, modify, translate, or create derivative works based on Site content
  • Use any content for commercial purposes or in any educational service offered to others
  • Remove, alter, or obscure any copyright, trademark, or proprietary rights notice

7.3 Prohibited Use of Content

The following actions are expressly prohibited and constitute infringement of the Company’s intellectual property:

  • Copying, reproducing, republishing, or distributing any Site content without prior written permission
  • Creating websites, applications, or materials that reproduce or closely imitate Site content
  • Posting Site content on social media, forums, or third-party platforms
  • Using Site content in any printed or digital publication
  • Creating “answer keys” or study materials derived from Site content for distribution

7.4 Prohibition on Automated Data Extraction and AI Training

You are explicitly and unconditionally prohibited from:

  • Using bots, spiders, scrapers, or any automated tool to access, download, or extract any content from the Site
  • Mass-copying or systematically extracting test questions, answers, explanations, or any other Site content
  • Building databases, datasets, archives, or collections of Site content in any format or medium
  • Using Site content — in whole or in part — as training data, fine-tuning data, evaluation data, reinforcement learning data, or any other input for any artificial intelligence, machine learning, or natural language processing system
  • Reproducing the structure, organization, or selection logic of Site content for competitive or commercial purposes

Such actions constitute a material breach of these Terms and a serious infringement of the Company’s copyright. Violations will result in immediate account termination without refund and will be pursued through all available legal remedies, including injunctive relief and claims for statutory damages under applicable copyright law.

7.5 DMCA Policy

The Company respects the intellectual property rights of others and expects users to do the same. If you believe that any content on the Site infringes your copyright, please send a DMCA takedown notice to info@testsdmv.com that includes all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the specific material on the Site claimed to be infringing, with sufficient detail to locate it (e.g., URL)
  4. Your contact information — name, address, telephone number, and email address
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  6. A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or are authorized to act on their behalf

We will respond to valid DMCA notices and take appropriate action, including removing or disabling access to infringing content. Counter-notifications and repeat infringer procedures are also available under the DMCA.

7.6 Enforcement

In the event of unauthorized use of our intellectual property, including scraping, content theft, or AI training data use, the Company reserves all legal remedies available, including:

  • Filing DMCA takedown notices with hosting providers, search engines, and content delivery networks
  • Seeking injunctive relief to immediately stop infringing activity
  • Pursuing claims for actual damages and lost profits, or statutory damages under copyright law
  • Pursuing claims in the jurisdiction of the infringer’s residence or place of business

8. Acceptable Use Policy

By using the Site, you agree to use it only for lawful purposes and in a manner consistent with these Terms. You agree not to:

  • Use the Site in any way that violates any applicable local, national, or international law or regulation
  • Transmit any unsolicited or unauthorized advertising or promotional material (spam)
  • Introduce or transmit any viruses, trojans, worms, ransomware, or other malicious code
  • Attempt to gain unauthorized access to any part of the Site, its servers, or connected systems
  • Conduct denial of service (DoS) or distributed denial of service (DDoS) attacks against the Site
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Engage in any conduct that interferes with or disrupts the integrity or performance of the Site
  • Collect or harvest any personally identifiable information from the Site without authorization
  • Use the Site in any manner that could damage, overburden, or impair the Site’s infrastructure

Violations of this Acceptable Use Policy may result in account suspension or termination and may be reported to appropriate law enforcement authorities.


9. User-Generated Content (Comments)

9.1 Submission of Comments

Users may post comments on certain pages of the Site. By submitting a comment, you represent and warrant that:

  • You are the author of the comment or have the right to submit it
  • The comment does not infringe any third party’s intellectual property, privacy, or other rights
  • The comment does not contain false, misleading, defamatory, obscene, offensive, or illegal content
  • The comment does not contain spam, advertising, or promotional material for any product or service

9.2 License to User Content

By posting a comment, you grant the Company a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, reproduce, display, distribute, translate, and incorporate your comment in connection with the Site’s services and the promotion thereof, without any obligation to compensate you.

9.3 Moderation

All comments are subject to pre-moderation. The Company reserves the right, at its sole discretion, to reject, edit, or delete any comment for any reason, including but not limited to spam, offensive language, off-topic content, or potential legal liability, without prior notice. Moderation decisions are final and are not subject to appeal.


10. Privacy and Data Protection

Your use of the Site is governed by our Privacy Policy and Cookie Policy, which describe in detail how we collect, use, share, and protect your personal data, including the specific purposes and legal bases for processing, your data protection rights, and how to exercise them.

Cookie consent on this Site is managed through WPConsent Pro, a fully self-hosted consent management platform. All consent preferences and consent records are stored exclusively on our own servers and are never transmitted to external consent management services. Non-essential cookies are blocked at the script level until you provide explicit opt-in consent through the cookie banner.

10.1 Right to Erasure

In compliance with GDPR (Article 17), CCPA, and other applicable privacy legislation, you have the right to request deletion of your account and associated personal data. You may initiate account deletion through your profile settings or by emailing info@testsdmv.com. Please note:

  • Account deletion is irreversible and permanently removes your access to purchased content and progress statistics
  • We may retain certain data as required by law (e.g., transaction records for tax purposes) as described in the Privacy Policy
  • We will process deletion requests within 30 days of receipt and verification of your identity

11. Modifications to the Site and Terms

11.1 Modifications to the Site

The Company reserves the right to modify, suspend, or discontinue any aspect of the Site or its services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Site or any part thereof.

11.2 Modifications to These Terms

We reserve the right to update or modify these Terms at any time. When we make changes, we will:

  • Post the updated Terms on this page with a revised “Last Updated” date
  • For material changes — those that significantly affect your rights or obligations — provide at least 30 days’ advance notice via: (a) a prominent notice on the Site, and (b) an email notification to registered account holders
  • For minor clarifications or corrections, post the updated Terms without prior notice

Your continued use of the Site after the effective date of any modified Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the Site. Previous versions of these Terms are available upon request at info@testsdmv.com.


12. Service Availability

The Site is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that the Site will be uninterrupted or error-free. The Company is not responsible for temporary unavailability arising from:

  • Scheduled or emergency technical maintenance
  • Third-party hosting or infrastructure failures
  • Distributed denial-of-service (DDoS) attacks or other security incidents
  • Force Majeure events as defined in Section 16

In the event of extended planned maintenance affecting access to paid content, we will make reasonable efforts to provide advance notice. Temporary unavailability does not entitle you to a refund.


13. Governing Law and Jurisdiction

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

13.2 Jurisdiction

Any dispute arising out of or relating to these Terms or the use of the Site that is not subject to arbitration under Section 14 shall be submitted to the exclusive jurisdiction of the courts located in the Republic of Kazakhstan.

13.3 Exception for Intellectual Property Enforcement

Notwithstanding the above, with respect to claims of intellectual property infringement (including but not limited to content scraping, unauthorized reproduction, or AI training data use), the Company reserves the right to seek injunctive relief and damages in any court of competent jurisdiction where the infringement occurs, where the infringing party resides, or where the infringing content is hosted, without regard to the general jurisdiction clause above.

13.4 Consumer Protection Laws

Nothing in these Terms is intended to limit any statutory rights that cannot be waived under applicable mandatory consumer protection law. To the extent any provision of these Terms conflicts with mandatory consumer protection rights applicable in your jurisdiction, those mandatory rights prevail.


14. Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY

This section requires individual arbitration and waives your right to sue in court or to participate in a class action. Nothing in this section limits non-waivable consumer rights under mandatory law.

14.1 Informal Dispute Resolution

Before initiating any formal arbitration proceeding, the parties agree to attempt to resolve any dispute through good-faith negotiation. You must send a written notice of your dispute to info@testsdmv.com, identifying the nature of the dispute and the relief sought. The parties will have 30 calendar days from receipt of such notice to attempt to resolve the dispute informally. If the dispute is not resolved within this period, either party may initiate arbitration.

14.2 Binding Arbitration

SUBJECT TO THE INFORMAL DISPUTE RESOLUTION PROCEDURE ABOVE, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE PRIVACY POLICY, THE COOKIE POLICY, OR YOUR USE OF THE SITE SHALL BE RESOLVED THROUGH BINDING ARBITRATION CONDUCTED IN ACCORDANCE WITH THE RULES OF THE INTERNATIONAL CHAMBER OF COMMERCE (ICC), AS AMENDED FROM TIME TO TIME.

The following rules apply to all arbitration proceedings:

14.3 Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR OTHER PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, MASS ACTION, OR REPRESENTATIVE PROCEEDING AGAINST THE COMPANY. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING.

14.4 Exceptions

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration, including in connection with intellectual property infringement claims.


15. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, contractors, agents, licensors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and costs of investigation) arising out of or related to:

  • Your access to or use of the Site or its content
  • Your violation of any provision of these Terms
  • Your violation of any third-party rights, including intellectual property, privacy, or contractual rights
  • Your submission of comments or other user-generated content
  • Any misrepresentation made by you
  • Unauthorized access to the Site under your account credentials

The Company reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense.


16. Force Majeure

The Company shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent such failure or delay is caused by events beyond the Company’s reasonable control, including but not limited to:

  • Acts of God, natural disasters, earthquakes, fires, or floods
  • Acts of government, regulatory changes, sanctions, embargoes, or export restrictions
  • War, armed conflict, terrorism, or civil unrest
  • Internet service disruptions, cyberattacks, or ransomware incidents affecting our infrastructure
  • Third-party service provider failures, including hosting providers, payment processors, or DNS services
  • Pandemics or public health emergencies declared by competent authorities

The Company will make reasonable efforts to notify users of any force majeure event that materially affects service availability and to restore service as quickly as commercially practicable.


17. Limitation Period

To the maximum extent permitted by applicable law, any claim or cause of action arising out of or relating to your use of the Site or these Terms must be brought within one (1) year from the date on which the cause of action accrued. Any claim not brought within this limitation period is permanently barred. This limitation period applies regardless of the form of action (contract, tort, statute, or otherwise), except where prohibited by applicable mandatory consumer protection law.


18. Miscellaneous

18.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect.

18.2 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between You and the Company with respect to the Site and supersede all prior and contemporaneous agreements, representations, warranties, and understandings regarding the subject matter hereof.

18.3 No Waiver

The Company’s failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver is only effective if made in writing and signed by a duly authorized representative of the Company.

18.4 Assignment

You may not assign or transfer your rights or obligations under these Terms, by operation of law or otherwise, without the Company’s prior written consent. The Company may assign its rights under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

18.5 Language

These Terms are written in English. Any translations provided are for convenience only. In the event of any conflict between the English version and a translated version, the English version shall prevail.

18.6 Headings

Section headings in these Terms are for convenience only and have no legal or contractual effect.
