Driving Under the Influence (DUI) is illegal when impaired by alcohol, drugs, or any controlled substance. The legal Blood Alcohol Concentration (BAC) limits are strictly enforced: 0.08% for drivers 21 and over, 0.04% for commercial drivers, and 0.02% for drivers under 21. Under the “Implied Consent” law, simply driving means you have agreed to a chemical test if arrested for DUI.
Penalties for DUI convictions are severe and increase with each offense, ranging from jail time, heavy fines, and license suspension for a first offense to felony charges for multiple offenses. Having a high BAC (0.17% or higher) or a minor in the vehicle are aggravating factors that lead to harsher penalties.
