It is illegal to drive with a Blood Alcohol Concentration (BAC) of 0.08% or higher (0.02% for drivers under 21). Under the “Implied Consent” law, simply having a license means you have agreed to a chemical test if suspected of DUI; refusing this test results in an immediate license revocation.
Penalties for DUI convictions are severe and increase with each offense. A first offense is a Class B misdemeanor with a minimum $500 fine and a 91-day license suspension. Aggravating factors, such as having a very high BAC or a child in the vehicle, lead to harsher penalties.
