The Laws on Operating While Intoxicated (OWI) in Michigan
In Michigan, it is illegal to operate a vehicle with a Blood Alcohol Concentration (BAC) at or above 0.08% for drivers 21 and over. For commercial drivers, the limit is 0.04%, and for drivers under 21, any BAC of 0.02% or higher violates the “Zero Tolerance” law.
Penalties for OWI convictions are severe and increase with each offense. A first offense is a misdemeanor with potential jail time, fines, license suspension, and mandatory alcohol education programs. A third offense is a felony.
