Florida DUI Laws
In Florida, you can be charged with a DUI if you are driving with a Blood Alcohol Concentration (BAC) of .08 or higher (.02 for drivers under 21). Penalties are severe and increase with each offense, including fines, jail time, license suspension, mandatory DUI school, and required ignition interlock devices.
Under Florida’s Implied Consent Law, you automatically agree to a chemical test if an officer has probable cause. Refusing this test results in an automatic one-year license suspension. Certain aggravating factors, like having a BAC of .15 or higher or having a minor in the vehicle, will lead to enhanced penalties.
