Driving Under the Influence of Intoxicants (DUII) in Oregon means operating a vehicle while impaired by alcohol, drugs, or a combination thereof. For drivers aged 21 and over, it is illegal to drive with a Blood Alcohol Concentration (BAC) of 0.08% or higher. Drivers under 21 are subject to a zero-tolerance law, meaning any detectable BAC is illegal.
Oregon has an “Implied Consent” law, meaning that by driving, you agree to a breath, blood, or urine test if an officer has probable cause to believe you are impaired. Refusing the test results in immediate administrative penalties, including license suspension, which are separate from criminal DUII charges.
