The Definition of Driving Under the Influence in Mississippi
In Mississippi, it is illegal to drive while impaired by alcohol, illegal drugs, or certain prescription medications. For drivers 21 and over, it is illegal to drive with a Blood Alcohol Concentration (BAC) of 0.08% or higher. For commercial drivers, the limit is 0.04%.
Drivers under 21 are subject to a “Zero Tolerance” law, making it illegal to drive with a BAC of 0.02% or higher. A BAC of 0.08% or higher for an underage driver results in a standard DUI charge.
