Chapter 4: DUI / DWI Laws

Use this guide to prepare for the exam, and refer to the official manual for complete details.

Operating a vehicle under the influence of alcohol or drugs is one of the most dangerous decisions a driver can make, leading to thousands of preventable deaths and injuries each year. Understanding Ohio’s strict OVI (Operating a Vehicle Impaired) laws is critical for passing the driver’s exam and, more importantly, for recognizing the severe legal and personal consequences of impaired driving. This chapter details the state’s zero-tolerance approach, from blood alcohol limits to the significant penalties offenders face.

In Ohio, it is illegal to operate any motor vehicle while under the influence of alcohol, drugs of abuse, or a combination of both. The state’s laws are designed to be strict, with significant penalties that apply immediately upon arrest and increase with subsequent offenses.

The legal term for driving under the influence in Ohio is OVI. An OVI charge can result from impairment by any substance that affects a person’s reflexes, judgment, and coordination.

Defining OVI: A driver can be charged with OVI if their ability to operate a vehicle is impaired to any noticeable degree. This includes impairment from alcohol, illegal drugs like marijuana or cocaine, and even legally obtained prescription or over-the-counter medications if they cause drowsiness or affect driving ability.

Blood Alcohol Concentration (BAC) Limits: Ohio has “per se” laws, meaning it is automatically illegal to drive with a BAC at or above a specific level, regardless of whether impairment is visibly obvious.

A chart compares four standard drinks—1.5 ounces of whiskey, 5 ounces of wine, 8–9 ounces of a cocktail, and 12 ounces of beer—indicating they are equivalent in alcohol content.
  • 21 or Older: 0.08% or higher
  • Under 21: 0.02% or higher
  • Commercial Drivers: 0.04% or higher (while operating a commercial vehicle)
