Nevada Implied Consent Law
By driving in Nevada, you have already given your “implied consent” to a chemical test of your blood, breath, or urine if an officer has reasonable grounds to believe you are DUI. Refusing to take this test triggers immediate administrative penalties from the DMV, separate from any criminal DUI charges.
A first refusal results in a one-year license revocation, and a second or subsequent refusal within seven years leads to a three-year revocation. These penalties are in addition to those for a DUI conviction.
