Colorado DUI Laws
In Colorado, a DUI (Driving Under the Influence) is defined as being substantially incapable of safe driving, typically with a BAC of 0.08% or higher. A DWAI (Driving While Ability Impaired) is a lesser charge for being impaired to the slightest degree. Impairment can be from alcohol, drugs, or a combination of both.
Colorado’s Express Consent Law means you automatically agree to a chemical test if an officer suspects impairment. Refusing the test results in an immediate one-year license revocation and a mandatory two-year ignition interlock device requirement, regardless of the criminal case outcome.
