“Implied Consent” Law

By driving in California, you have implied consent to a chemical test (breath, blood, or urine) if you are lawfully arrested for a DUI. Refusing to take a test after a lawful arrest will result in an automatic license suspension.

Penalties for refusal are separate from criminal DUI charges and include additional jail time and longer license suspensions. A refusal can also be used as evidence against you in court.
